PFT: Why Chargers are shielding Te'o from media

Te'oAP

It?s essentially a Te?obargo, and the Chargers now admit they won?t be making their second-round pick available to the media at all until the middle of June.

So why are they not letting Te?o talk?? Chargers director of public relations Bill Johnston addressed the situation today on XTRA Sports 1360 in San Diego.

?Right now, anything that he does . . . makes news,? Johnston said.? ?Right now, the news that people are talking about with him is really not the news that we want him to be talking about.? Really, he?s a rookie, he?s a second-round draft pick, yet everybody wants to talk to him.? Well, why?? Well, it all goes back to that stuff that happened back in the winter, and back when he was at Notre Dame.

?To us, that?s not what we want him talking about.? We want him focused on becoming a Charger, on becoming a better player.? Learning our system.? Getting comfortable here.? We want him talking football, talking Chargers, and that?s all we want him focused on right now.? So we?re doing what we think is in his best interests to stay focused and become the best player he can.?

That really doesn?t make much sense, frankly.? Media availability inherently is a distraction, regardless of the topics addressed.? Any time spent talking to the media takes away from Te?o's effort to become a better player and learn the system.

Moreover, the furor regarding the Lennay Kukua nonsense largely has subsided.? It wasn?t, for example, much of an issue during the first session between Te?o and the media on May 10, in connection with the team?s rookie minicamp.

Of course, the controversy can remain relevant if Te?o does things to keep it relevant.? For example, he chose to attend the Maxim party honoring a list of women that included the non-existent Kukua.? Under the circumstances, it?s fair game to ask him why he did it.

It?s not fair game for the Chargers to protect him, or anyone other player simply because the team wants him to talk about certain subjects and not others.? Watch the video from the May 10 session; the kid can handle himself well.? Besides, they picked him knowing what having him on the team would entail.? It?s short-sighted to treat him differently than every other player.

Think of the message that sends this to the locker room, at a time when he?d love nothing more than to simply be one of the guys.? He?s necessarily not one of the guys, because the team is giving him different treatment than the rest of his teammates.

Meanwhile, the team is making the issue even bigger than it should be, giving Te?o yet another topic to address when he finally talks to the media and making it harder for him to lay the foundation for a positive relationship with the folks who buy ink by the truckload.

While it?s hard for any organization to reverse a decision that has been made and implemented, the best move for the Chargers would be to treat Te?o no differently than any other player ? and to hope that the media eventually will do the same thing.

Freeport Indonesia: Death toll rises to 28 after tunnel accident

JAKARTA (Reuters) - The death toll from a tunnel collapse at the world's second largest copper mine run by Freeport McMoRan Copper & Gold Inc's Indonesian unit was raised to 28 on Wednesday as rescuers gave up hope of finding any more survivors.

Arizona-based Freeport closed the remote Papua mine on Wednesday last week, a day after a training tunnel away from its main operations fell in on 38 workers. Ten workers were rescued, but the search for the seven still listed as missing has now turned into an attempt the retrieve their bodies.

"We continue to grieve with the families even as we close this grim chapter," Freeport Indonesia President Director Rozik Soetjipto said in a statement.

"There is still much to do for us to provide the best care and support for the injured and the families of the bereaved."

Although Indonesia's mining sector has a poor safety record, last week's tunnel accident is one of the country's worst-ever mining disasters, industry officials say.

Soetjipto said on Saturday that once the rescue efforts were finished the company would launch an investigation with the help of international experts and Indonesian government officials.

Freeport emergency response teams, who are working around the clock to try to recover the remains of the dead, have been hampered by narrow tunnels and loose rock at the site, Wednesday's statement said.

It made no mention of the investigation or the current suspension of mining operations.

A union leader last week demanded that Freeport keep the mine closed while the cause of the accident was investigated.

The incident's impact on global copper supply has so far been limited as the Grasberg mine keeps stockpiles in reserve in case of disruptions, but that would change if any investigation and closure drags on.

Obama walks a fine line with Myanmar president's landmark visit

By Paul Eckert

WASHINGTON (Reuters) - President Barack Obama will walk a fine line between fostering a U.S. ally in China's backyard and trying to defend human rights on Monday when the president of Myanmar becomes the first head of his country to visit the White House in 47 years.

Rights groups and some U.S. lawmakers fear Obama has moved too quickly since forging a dramatic breakthrough in relations in 2011 after half a century of military rule in Myanmar, also known as Burma.

U.S. officials argue that reforms by President Thein Sein's quasi-military government - freeing democracy activist Aung San Suu Kyi and hundreds of political prisoners, scrapping censorship, legalizing trade unions and protests - are transformative and deserve support from Obama, who confirmed the end of Myanmar's pariah status with the West with a landmark in November.

However, ethnic or sectarian violence, particularly in the western state of Rakhine, has worsened since Washington started easing sanctions, and a Reuters special report published last week found apartheid-like policies segregating minority Muslims in prison-like ghettos there.

At least 192 people died last year in violence between ethnic Buddhists in Rakhine and Rohingya Muslims, who are denied citizenship by Myanmar. Most of the victims, and the 140,000 people made homeless in the attacks, were Muslims.

Rohingya Muslims, in addition to the violence, "experience severe forms of legal, economic, educational, and social discrimination," the U.S. State Department said in an annual report on religious freedom published on Monday.

"We see societal and economic reform there, but on religious freedom we haven't seen much reform," said Suzan Johnson Cook, U.S. ambassador-at-large for international religious freedom.

The Myanmar government's rights record has long been poor, especially in resource-rich areas inhabited by ethnic Shans, Karens and Kachins.

The Washington-based U.S. Campaign for Burma says 1,100 ethnic Rohingya and 200 to 250 Kachin have become political detainees in the past year, and the situation has led some to question how far Washington should go in its policy shift.

"When they abuse ethnic minorities, it really undercuts their credibility and undermines our ability to work with them," said Republican U.S. Representive Trent Franks, one of a group of lawmakers arguing for lifting U.S. sanctions more slowly.

Obama administration officials believe that to deepen and sustain the reforms, Thein Sein has to be able to demonstrate tangible benefits to overcome opposition from powerful military leaders. To back that, Washington has narrowed the scope of its ban on business dealings with Myanmar officials and businessmen.

"Yes, there is still more work to do but ... the progress they have made has been significant and they have put in place an ambitious reform agenda and we encourage them to keep doing more," State Department spokeswoman Jen Psaki said on Friday, after Myanmar freed 23 political prisoners.

On Monday, the two countries were expected to announce plans to work out a Trade and Investment Framework Agreement that would lead to regular talks on boosting trade, labor standards and investment, a business leader familiar with the issue said.

STRATEGIC IMPORTANCE

Even critics in Congress of Obama's Myanmar policy support the U.S. strategic goal of bringing Myanmar, a nation of 60 million people tucked between China and India, out of its isolation from the West.

The long U.S.-Myanmar estrangement was a drag on America's relations with ASEAN, the 10-nation Southeast Asian regional grouping that looks to Washington as a counterbalance to the more assertive China of recent years.

Ernest Bower, senior adviser for Southeast Asia at the Center for Strategic and International Studies, said improving relations with Myanmar fits into the wider U.S. policy of revitalizing its Asia-Pacific relationships.

"Myanmar is the keystone state that links China, Southeast Asia and India, and if we didn't get it right, we wouldn't be able to play the chess game that is required in order to deal with China," he said.

But the concerns about rights abuses are holding back a fuller U.S. embrace of Thein Sein, a retired general, who was taken off the U.S. Treasury Department's Specially Designated Nationals visa blacklist last year to facilitate engagement.

Thein Sein was a close confidante of former military ruler Than Shwe, who ran Myanmar for 19 years, a period that saw mass jailing of opponents, the gunning down of pro-democracy protesters and widespread abuses in ethnic minority areas.

Jennifer Quigley, head of the U.S. Campaign for Burma, said that even without the killings in Rakhine, the Myanmar military's heavy hand in forced land seizures and corrupt trade in natural resources in Kachin and other states in multi-ethnic Myanmar should give Western countries pause.

Myanmar's most coveted resources - natural gas, minerals, gems and timber - lie in ethnic areas that have been war zones for decades and remain largely untouched by reforms, she said.

"Our biggest concern about welcoming Thein Sein to the White House is that it reinforces this positive impression of him and of what is going on in Burma, while we have serious misgivings that he is not interested in pursuing critical reforms," said Quigley.

The military has run Myanmar since a 1962 coup by Ne Win, whose 1966 visit to Washington at the invitation of President Lyndon Johnson was the last such visit by the country's head of state.

The European Union has moved faster than the United States on Myanmar, lifting its last sanctions on trade, the economy and individuals last month, although it retains an arms embargo.

Earlier this month, Obama scrapped a ban on U.S. entry visas to Myanmar's military rulers and their associates but kept sanctions on investing or doing business with figures involved in repression since the mid-1990s.

Franks and Democratic U.S. Representative Rush Holt are using budget legislation to press the Obama administration to hold back on expanding nascent U.S. military ties with Myanmar's armed forces until the country stops abuses of ethnic groups and enacts reforms to reduce the military's huge role in the economy.

"The Burmese military is the historic perpetrator of human rights abuses, and, one may presume, also the current perpetrator, so sanctions against them should be the last to go," said Holt.

(AP) ? President Barack Obama is telling graduates of Morehouse College to take the power of their example ? as black men graduating from college ? and use it to improve people's lives.

He's asking those headed to law school to think about defending the poor, and those destined for medical school to consider treating people in communities without access to health care.

And he asked those with MBAs in their near future to think about how to put people to work or turn around a struggling neighborhood.

The president said graduates should inspire those who look up to them.

About 500 students were receiving undergraduate degrees from the historically black, all-male institution in Atlanta, becoming "Morehouse Men."

After the speech, Obama was to attend a Democratic Senate fundraiser, also in Atlanta.

How To Trademark Your Brand | MiSS V INC? We Brand You?

?

After a trademark battle with Florida-based cosmetics company Kroma, the Kardashian sisters changed the name of their makeup line from Khroma Beauty to Kardashian Beauty.

The name of Kourtney, Khloe and Kim Kardashian?s new makeup line was recently tangled up in a legal battle.

It was a beauty battle for a name and the Kardashians lost.

Sisters Kourtney, Kim and Khloe renamed their Khroma Beauty line to Kardashian Beauty after nearly a yearlong trademark battle with a Florida cosmetics company similarly named Kroma.

The brand is managed by Santa Monica, a California based Boldface Licensing and Branding firm. It will be allowed to sell out its existing products under the Khroma name.

Boldface will pay about USD 5 million in royalties to Lee Tillet Inc that owns Kroma Makeup.

?We?re confident that it?s not the name that matters to our fans, but the Kardashian sisters? commitment to making this line a true reflection of their love for cosmetics, said Nicole Ostoya, Boldface?s chief executive officer.

Trouble for the reality star sisters began last June, when Kroma sent a cease-and-desist letter, demanding the Kardashians drop the Khroma name.

Boldface responded by filing suit against Kroma, seeking affirmation their name was not a trademark infringement. Kroma countersued, claiming the Kardashians? brand was costing them millions in lost sales.

Here is advice on how to correctly ?trademark and protect your brand legally to avoid the same pit falls as the Kardasians.

While the best defense against copycat competitors is to stay ahead of them with a continuous stream of innovative, highly differentiated, and superior products and services, it is equally important to seek as much legal protection as possible for your brand.

Trademark Law
As a brand steward, you must be aware of the laws under which legal protection is available.? First, trademark law protects a brand?s identity.? That is, it protects names, titles, taglines, slogans, logos, other designs, product shapes, sounds, smells, colors or any other features that distinguish one source of products or services from another. Trademarks that protect services are often called service marks (?SM?).? There are also ?collective membership marks? (Boy Scouts of America) and ?certification marks? (UL approved).

Trademarks, like brands, build in strength over time.? The test for trademark infringement is ?confusing similarity.?? Put another way, if the average consumer believes both products to have come from the same source, there is infringement. Obviously, the more a consumer is familiar with a particular brand, the more defendable its mark.? That?s why it behooves a company to do the following:

?choose a distinctive mark, including a ?coined? name. (brand names range from generic and descriptive to suggestive and arbitrary or fanciful (?coined?).? Obviously it takes longer to build meaning for ?coined? names, but they are also more distinctive and easiest to protect legally.? Kodak, Xerox, and Exxon fall in that category.? Suggestive marks are the next most protectable.? Examples include Coppertone, Duracell, and Lestoil.? Even common words can be used as trademarks as long as they are not used descriptively.? These common words/phrases are also suggestive marks: Amazon (big), Road Runner (fast) and Apple (different, offbeat).? Descriptive marks are not protectable unless the brand creates a secondary meaning for the word.? Examples include Weight Watchers, Rollerblade, and Wite-out.? Generic marks, such as Shredded Wheat and Super Glue, are not protectable at all.)

?? ? avoid geographic names as a part of your mark ? they can be the basis of trademark refusal
?? ? register the mark
?? ? be consistent in its use of the mark
?? ? create strong trade dress (mentioned below)
?? ? widely advertise and distribute its trademarked products
?? ? do all of this over a long period of time.

Because the strength of a mark is dependant upon consumers? familiarity with it, it is much easier for a competitor to neutralize your mark soon after it has been introduced than after it has been in use for a long period of time.

Courts use the following tests to determine infringement:
?? ? strength of the trademark claiming infringement
?? ? similarity of the two marks
?? ? evidence of consumer confusion
?? ? care a consumer takes in comparing products
?? ? intent of the organization in using the potentially infringing mark. (Some drug and grocery stores have used generic brands that emulate a leading brand?s package shape, colors, typestyle, formulation, etc. side-by-side with the leading brand to imply that there are no differences between the two, encouraging consumers to purchase the lower priced generic item.? In this situation, there is clearly intent to emulate the leading brand and reduce the perceived differentiation and value advantage of that brand, but it is not clear that there is intent to deliberately cause confusion as to source.)
?? ? relatedness of the two businesses
?? ? overlap between communication and distribution channels

By using the mark in association with your products and services over time, you gain trademark protection.? Registering your mark (marks can be registered at the state and federal levels) provides additional protection. While common law and federal trademark statute protect an unregistered mark, registering your mark transfers the burden of proof to the second comer in challenging a mark?s registration.? With federal registration, you can sue infringers in Federal court.? Also, after five years of registration, the mark becomes incontestable.? Federal trademark registrations last ten years and can be renewed every ten years ad infinitum.

You can acquire trademark rights in one of two ways.? To acquire trademark rights based on use in commerce, you must be the first person or organization that uses the mark in conjunction with the products or services for which trademark protection is sought.? To acquire the mark base upon intent to use, you must apply to register the mark through the United States Patent and Trademark Office.
Before choosing a trademark, first conduct a simple search to weed out marks that are not available.? This search can be done online for free.? (See online resources at the end of this chapter.)? After that, for the remaining candidates, conduct a full search through a law firm specializing in trademark law or an experienced trademark search firm.

Strong brands run the danger of becoming category descriptors.? Always use trademarks as adjectives, not verb or nouns.? If your brand is in danger of becoming a category descriptor, consider talking about your brand in the following way: ?Jell-O? gelatin,? ?Kleenex? facial tissue? and ?Xerox? photocopier? to differentiate the brand from the category.

Netanyahu takes aim at weapons leakage in Syria

By Jeffrey Heller

JERUSALEM (Reuters) - Prime Minister Benjamin Netanyahu held out the prospect on Sunday of further Israeli strikes inside Syria, pledging to act to prevent advanced weapons from reaching Hezbollah and other militant groups.

Although Israel has not publicly taken sides in the civil war between Syrian President Bashar al-Assad and rebels trying to topple him, Western and Israeli sources say it has launched air strikes in Syria to destroy weapons it believed were destined for Lebanon's Hezbollah.

In public remarks at the weekly meeting of his cabinet, Netanyahu made no direct mention of those attacks, but said Israel was prepared to take action in the future and was "preparing for every scenario" in the Syrian conflict.

Israel had a policy "to prevent, as much as possible, the leakage of advanced weapons to Hezbollah and terror elements", he said.

"We will act to ensure the security interest of Israel's citizens in the future as well."

Tzipi Livni, a member of Netanyahu's security cabinet and a former foreign minister, said: "I don't think there is anyone in Israel eager to take action" in Syria, hinting at concerns that any strike could provoke a wider conflict.

In an interview with Israel's Army Radio, Livni also said Israeli politicians ought to avoid taking sides.

"Israel isn't popular in Syria. Therefore any such statement could only be used as ammunition by one of the sides to try and divert the debate or the violence toward Israel and that's the last thing we need," Livni said.

Israel has neither confirmed nor denied reports that it attacked Iranian-supplied missiles stored near Damascus this month that it believed were awaiting delivery to Hezbollah, which fought a war with Israel in 2006 and is allied with Assad.

SUPERSONIC MISSILE

A Russian shipment of Yakhont anti-ship missiles to Syria was condemned by the United States on Friday, and Israel is also alarmed by the prospect of Moscow supplying S-300 advanced air defense missile systems to Damascus.

Netanyahu held talks in Russia on Tuesday with President Vladimir Putin on the Syrian crisis but gave no public indication whether Israel's concerns over the Russian weaponry had been eased.

Amos Gilad, a senior Israeli Defence Ministry official, said on Saturday the S-300 and the Yakhont, weapons that could complicate any plans for foreign military intervention in Syria, would likely end up with Hezbollah and threaten both Israel and U.S. forces in the Gulf.

"Yakhont is a cruise missile that can hit targets at sea and strategic targets. (It is) a supersonic missile, (with) a range of 300 km, very sophisticated," Gilad said on Israel's Channel Two television on Saturday.

"The Russians sent it to Syria, beside the strategic defense system called the S-300. There are a number of versions, and they are sending them one of the good versions," he said.

General Martin Dempsey, chairman of the U.S. Joint Chiefs of Staff, said on Friday Russia's delivery of anti-ship missiles to Assad was "ill-timed and very unfortunate" and risked prolonging a war that has already killed more than 80,000 Syrians.

A spokesman for Putin, while not responding directly to assertions Russia had sent the anti-ship missiles, said Moscow would honor contracts to supply Syria, a long-time weapons customer.

House bill to have more stringent immigrant controls: aides

By Richard Cowan

WASHINGTON (Reuters) - A bipartisan plan brokered in the House of Representatives will be tougher on illegal immigrants living in the United States than a Senate counterpart, congressional aides said on Friday.

But it fails to address the difficult issue of how many low-skilled foreign workers should be allowed into the country.

Late on Thursday, the eight Republican and Democratic House negotiators working on an immigration bill announced that they had successfully wrapped up a four-year effort and had hammered out a tentative deal.

Republican Representative Mario Diaz-Balart of Florida, one of the negotiators, told reporters on Friday that he was "confident" that the deal will get a full airing in the House Judiciary Committee that has oversight of immigration policy.

Many Republican members of that panel are opposed to moving a comprehensive bill and instead want to take smaller steps to further bolster U.S. borders against illegal crossings and to improve access for foreign high-skilled workers.

While the lawmakers themselves refused to discuss details, which will be translated into legislative language over the next week or two, some congressional aides familiar with the plan sketched out bits of the agreement on Friday.

According to those aides, the House measure, as expected, will set a 15-year path to citizenship for the approximately 11 million undocumented residents, many of whom have been in the United States for years and are raising families here.

The Senate bill, which is now being debated in that chamber's Judiciary Committee, sets a 13-year time frame.

Like the Senate bill, those illegal immigrants who are serving in the military or who were brought over the border as children with their parents, would be put on a faster path to citizenship. But details were not available.

The Service Employees International Union said the tentative deal showed that momentum for immigration legislation was building. Eliseo Medina, secretary-treasurer of the 2.1 million-member union, added that it was "the responsibility of the House leadership to ensure this bipartisanship continues."

UNRESOLVED DISPUTE

Congressional aides confirmed that the negotiators failed to agree on one of the most contentious issues in immigration reform efforts: the future flow of workers from abroad that American firms want to hire as construction workers, hotel maids, waiters and for other low-skilled jobs.

Instead, if and when a comprehensive immigration bill reaches the full House, Democrats and Republicans will offer competing amendments to try to resolve the matter, according to aides. Republicans control the House by a narrow majority.

The bill in the Democratic-controlled Senate relies on a low-skilled worker program that was worked out by the U.S. Chamber of Commerce and the AFL-CIO labor organization.

That deal has been criticized by some business interests as providing too few slots for foreign workers hoping to apply for American construction jobs. Labor unions have been pushing hard for stringent controls, saying a flood of foreign workers would displace domestic job-seekers.

Aides said that the House deal also would be more stringent than the Senate bill by requiring the Department of Homeland Security (DHS) to achieve new border security measures before the 11 million undocumented immigrants could begin moving into legal status.

The Senate effort requires DHS to pursue tough border security measures. But the 11 million would be able to move almost immediately to temporary legal status.

However, in at least one area, the House measure might be viewed as more progressive than the Senate bill, according to an aide.

"People will find the family reunification (provision) is better under the House plan than the Senate plan," the aide said. Like the Senate bill, the House deal eliminates an avenue for siblings living abroad to win visas.

But the aide said the House bill will grant more leeway than its Senate counterpart on granting visas to adult offspring of U.S. residents.

One of the last areas of disagreement among the House negotiators had to do with whether newly legalized residents would be able to participate in President Barack Obama's healthcare law.

Republicans want to include a provision specifying that they would have to buy their own health insurance.

It was not yet clear how that dispute was worked out.

Bills DE Williams fails to mediate ring dispute

BUFFALO, N.Y. (AP) ? Bills defensive end Mario Williams isn't any closer to getting back his $785,000 diamond engagement ring from his former fiancee, Erin Marzouki.

And Marzouki's attorney, Tony Buzbee, upped the ante on Friday by releasing a series of text messages he said were between his client and Williams that indicate how despondent the player was over their breakup in November.

Without going into detail, Buzbee said in an email that a court-encouraged effort to mediate the dispute was unsuccessful in Houston earlier in the day.

Accusing Williams of experiencing "dramatic mood swings" throughout the engagement, Buzbee also released an exchange of texts between the two he said he copied off his client's phone. It's a conversation dated as occurring between 4:51 and 8:26 p.m. Central Time on Nov. 11, and includes a break between 5:03-8:02 p.m.

During the exchange, Williams wrote: "No money in the world should leave me with suicidal thoughts."

Williams also wrote that he took three hydrocodones that morning ? that was the day of Buffalo's game at New England. And he planned to take two more on the plane home. Hydrocodone is classified as a narcotic, and prescribed to relieve moderate to severe pain.

Marzouki responded by urging Williams to get help.

"Why don't you talk to someone? Clearly you're not happy & if your takin pills that's bad," she wrote.

Williams apologized, and then wrote he agreed with her that he's furious and should not have texted her in "this state." Williams added: "I need to go back n my shell. There's no telling what Ill do to myself at this point. I'm sry Ill disappear from now on."

Messages left with Williams and his attorney, Monica Orlando, weren't returned.

Williams did post several notes on his Twitter account Friday night ? among his first since July. Though they didn't mention Marzouki or the lawsuit, the messages posted were in defense of his character.

"I'm still here and always will be," Williams wrote. "I'm too strong for ridicule and the childish extremes those will do to try and taint a persons name when in reality you make me stronger, hungrier and more determined."

In a separate post, he wrote: "The true character of someone is always revealed in times that we don't typically agree with. In these times it's how you respond and portray yourself to others that shows the ethics, character and true morals of a person. What's shown speaks for itself!"

Williams filed a lawsuit in Texas' Harris County district court May 3, demanding Marzouki return the ring and accusing her of breaking off the engagement in January. He alleged, Marzouki never had any intention of marrying him, accused her of absconding with the ring and using the relationship as a means to get at his money.

Williams is entering his second season with Buffalo. In March of last year, the Bills signed the free agent to a six-year, $100 million contract ? the richest awarded to an NFL defensive player.

Marzouki filed a countersuit this past week, calling Williams' claims "ridiculous" and "patently false," and accused the player of breaking off the engagement.

Marzouki added that Williams made it "abundantly clear in writing" that he wanted her to keep the ring following their last of many breakups in December. And, she said, Williams also communicated his wishes in text messages to her father and brother.

On Friday, Buzbee accused Williams of filing the lawsuit out of anger after Marzouki refused to reconcile after the last breakup.

"Ms Marzouki will not be bullied," Buzbee wrote. "In the court system, no matter how rich you are, everyone is treated equally."

Buzbee released a three-page long series of texts off his client's phone. The first 15 were blacked out, as were the last 15. In between, there were 30 consecutive texts that were shown to be exchanged between Williams and Marzouki.

Williams writes: "Ill focus on getting better all together and being string for myself." He then added: "Leave it alone. It's my business. I will get through it."

Marzouki responded by urging Williams to get help, and added: "The way you are handling it us incredibly self destructive."

Williams was at the Bills facility last week taking part in a three-day voluntary minicamp, and briefly discussed the lawsuit on Tuesday.

He referred to it as "something that happened and it is what it is," adding he doesn't believe it will be a distraction.

"When I'm here, this is my haven, this is my family and this is the most important thing for me, being around these guys," Williams said. "It's all about us, it's not about anything else. Anything personal is personal. You don't mix that with what we're trying to accomplish here."

Stacking 2-D materials produces surprising results

May 16, 2013 ? New experiments reveal previously unseen effects, could lead to new kinds of electronics and optical devices. Graphene has dazzled scientists, ever since its discovery more than a decade ago, with its unequalled electronic properties, its strength and its light weight. But one long-sought goal has proved elusive: how to engineer into graphene a property called a band gap, which would be necessary to use the material to make transistors and other electronic devices.

Now, new findings by researchers at MIT are a major step toward making graphene with this coveted property. The work could also lead to revisions in some theoretical predictions in graphene physics.

The new technique involves placing a sheet of graphene -- a carbon-based material whose structure is just one atom thick -- on top of hexagonal boron nitride, another one-atom-thick material with similar properties. The resulting material shares graphene's amazing ability to conduct electrons, while adding the band gap necessary to form transistors and other semiconductor devices.

The work is described in a paper in the journal Science co-authored by Pablo Jarillo-Herrero, the Mitsui Career Development Assistant Professor of Physics at MIT, Professor of Physics Ray Ashoori, and 10 others.

"By combining two materials," Jarillo-Herrero says, "we created a hybrid material that has different properties than either of the two."

Graphene is an extremely good conductor of electrons, while boron nitride is a good insulator, blocking the passage of electrons. "We made a high-quality semiconductor by putting them together," Jarillo-Herrero explains. Semiconductors, which can switch between conducting and insulating states, are the basis for all modern electronics.

To make the hybrid material work, the researchers had to align, with near perfection, the atomic lattices of the two materials, which both consist of a series of hexagons. The size of the hexagons (known as the lattice constant) in the two materials is almost the same, but not quite: Those in boron nitride are 1.8 percent larger. So while it is possible to line the hexagons up almost perfectly in one place, over a larger area the pattern goes in and out of register.

At this point, the researchers say they must rely on chance to get the angular alignment for the desired electronic properties in the resulting stack. However, the alignment turns out to be correct about one time out of 15, they say.

"The qualities of the boron nitride bleed over into the graphene," Ashoori says. But what's most "spectacular," he adds, is that the properties of the resulting semiconductor can be "tuned" by just slightly rotating one sheet relative to the other, allowing for a spectrum of materials with varied electronic characteristics.

Others have made graphene into a semiconductor by etching the sheets into narrow ribbons, Ashoori says, but such an approach substantially degrades graphene's electrical properties. By contrast, the new method appears to produce no such degradation.

The band gap created so far in the material is smaller than that needed for practical electronic devices; finding ways of increasing it will require further work, the researchers say.

"If ? a large band gap could be engineered, it could have applications in all of digital electronics," Jarillo-Herrero says. But even at its present level, he adds, this approach could be applied to some optoelectronic applications, such as photodetectors.

The results "surprised us pleasantly," Ashoori says, and will require some explanation by theorists. Because of the difference in lattice constants of the two materials, the researchers had predicted that the hybrid's properties would vary from place to place. Instead, they found a constant, and unexpectedly large, band gap across the whole surface.

In addition, Jarillo-Herrero says, the magnitude of the change in electrical properties produced by putting the two materials together "is much larger than theory predicts."

The MIT team also observed an interesting new physical phenomenon. When exposed to a magnetic field, the material exhibits fractal properties -- known as a Hofstadter butterfly energy spectrum -- that were described decades ago by theorists, but thought impossible in the real world. There is intense research in this area; two other research groups also report on these Hofstadter butterfly effects this week in the journal Nature.

The research included postdocs Ben Hunt and Andrea Young and graduate student Javier Sanchez-Yamagishi, as well as six other researchers from the University of Arizona, the National Institute for Materials Science in Tsukuba, Japan, and Tohoku University in Japan. The work was funded by the U.S. Department of Energy, the Gordon and Betty Moore Foundation and the National Science Foundation.

New method proposed for detecting gravitational waves from ends of universe

May 16, 2013 ? A new window into the nature of the universe may be possible with a device proposed by scientists at the University of Nevada, Reno and Stanford University that would detect elusive gravity waves from the other end of the cosmos. Their paper describing the device and process was published in the physics journal Physical Review Letters.

"Gravitational waves represent one of the missing pieces of Einstein's theory of general relativity," Andrew Geraci, University of Nevada, Reno physics assistant professor, said. "While there is a global effort already out there to find gravitational waves, our proposed method is an alternate approach with greater sensitivity in a significantly smaller device.

"Our detector is complementary to existing gravitational wave detectors, in that it is more sensitive to sources in a higher frequency band, so we could see signals that other detectors might potentially miss."

Geraci and his colleague Asimina Arvanitaki, a post-doctoral fellow in the physics department at Stanford University, propose using a small, laser-cooled, tunable sensor that "floats" in an optical cavity so it is not affected by friction. Geraci is seeking funding to begin building a small prototype in the next year.

"Gravity waves propagate from the remote corners of our universe, they stretch and squeeze the fabric of space-time," Geraci said. "A passing gravity wave changes the physically measured distance between two test masses -- small discs or spheres. In our approach, such a mass experiences minimal friction and therefore is very sensitive to small forces."

While indirect evidence for gravity waves was obtained by studying the changing orbital period of a neutron star binary, resulting in the 1993 Nobel Prize in Physics, gravity waves have yet to be directly observed.

"Directly detecting gravitational waves from astrophysical sources enables a new type of astronomy, which can give us "pictures" of the sky analogous to what we have by using telescopes," Geraci said. "In this way the invention of a gravitational wave detector, which lets us "see" the universe through gravity waves, is analogous to the invention of the telescope, which let us see the universe using light. Having such detectors will allow us to learn more about astrophysical objects in our universe, such as black holes."

The approach the authors describe can exceed the sensitivity of next-generation gravitational wave observatories by up to an order of magnitude in the frequency range of 50 to 300 kilohertz.

Their paper, "Detecting high-frequency gravitational waves with optically levitated sensors," appeared in Physical Review Letters, a publication of the physics organization American Physical Society.

Geraci also presented his research at the annual American Physical Society Meeting in Denver in April. The meeting is attended by particle physicists, nuclear physicists and astrophysicists to share new research results and insights.

LA is worst city for dog attacks on mail carriers

WASHINGTON (AP) ? The U.S. Postal Service says Los Angeles was the worst city in America for dog attacks on letter carriers last year, and it urged pet owners to help reduce the attacks.

The agency on Wednesday released its city rankings ahead of National Dog Bite Prevention Week, which starts Monday. The Postal Service said nearly 5,900 postal workers were attacked last year, a tiny portion of the 4.7 million Americans bitten by dogs annually.

Los Angeles was the worst with 69 attacks, followed by San Antonio with 42 and Chicago with 41. The city with the least attacks was Wichita, Kan., with 20.

If letter carriers feel threatened by a dog, they can skip delivery to the house and ask the customer to retrieve any mail at the post office instead.

KEF M500 and M200 headphones launched in Hong Kong, we go ears-on

Image

It's been almost a month since KEF announced its first headphone series, and yesterday we finally got the chance to try out its M500 cans and M200 in-ears at the company's Hong Kong launch event. In fact, it's worth noting that while KEF originated from the UK 52 years ago, it's been part of Hong Kong's Gold Peak Group since 1992. That said, much of KEF's R&D is still done back in an English county called Kent, where the engineers attempted to port their company's sonic signature over to its M series headphones. The result? Let's just say we prefer one to the other.

Groupon launches Breadcrumb iPad app, vows to not be a typical POS

Groupon launches Breadcrumb iPad app, vows to not be a typical POS

Yesterday, Groupon POS appeared in the iTunes Store, but was quickly pulled. Now we know why. Breadcrumb POS, which is the official name of yesterday's leaked point-of-sale iPad app, is now officially available, bringing a simple interface and a handful of financial incentives. The application, which can be downloaded for free, charges vendors a credit card processing fee of 1.8 percent plus 15 cents per transaction, assuming you're swiping plastic from MasterCard, Visa or Discover. In an effort to get small businesses signed up, however, Groupon is offering to cover the fees on the first $5,000 in credit card transactions, a savings of $90 by our calculations, plus whatever you'd be paying per swipe.

The app enables you to log transactions, manage menu items and issue refunds, in addition to processing credit cards and emailing receipts. The POS uses Breadcrumb Payments for processing, with deposits posting within 24 hours, and can be paired with a card swiper and optional printer (you can email receipts if you'd prefer). There's also free 24/7 telephone support, should you run into any issues while using the system. Breadcrumb POS won't replace the more sophisticated Pro version, which is available starting at $99 per month, and retailers will still be able to use the Groupon Merchants App for redeeming vouchers and processing supplemental payments. If the new Breadcrumb POS sounds like a fit, snag some more info at the source link below.

Groundwater isolated for eons

At least 1.5 billion years after it last saw the surface, flowing liquid may host life

At least 1.5 billion years after it last saw the surface, flowing liquid may host life

By Erin Wayman

Web edition: May 15, 2013

Drilling more than two kilometers into the ground beneath Canada, geologists have struck scientific gold: pockets of flowing water isolated underground for at least 1.5 billion years and perhaps as long as 2.64 billion years.

The water is rich in hydrogen and methane, which nourish microbes living today near hydrothermal vents on the seafloor. That means the deposits may harbor ancient lineages of life cut off from the surface for eons, the researchers report in the May 16 Nature.

Although the water has not yielded any evidence of life to date, the researchers intend to start looking. And because ancient rocks on Mars share a similar mineral composition, the finding suggests that the Red Planet could also be home to deeply buried life, says coauthor Barbara Sherwood Lollar, a geochemist at the University of Toronto.

The study ?makes a good case that if there was ever a biosphere on Mars, then tiny remnants of that biosphere are very likely preserved underground,? says planetary scientist Chris McKay of NASA Ames Research Center in Moffett Field, Calif. But he doesn?t expect imminent confirmation of that proposition. ?Considering that after 40 years of Mars exploration we have managed to drill only a few centimeters, it may be a long time before we can follow up on this idea.?

The discovery comes from boreholes drilled in an Ontario zinc and copper mine. The water is in fractures in rocks that were part of the seafloor roughly 2.7 billion years ago. Over time, volcanic eruptions and other geologic activity buried the rocks and trapped the water.

Sherwood Lollar and colleagues embarked on their Ontario research after discovering water in a South African gold mine that had been separated from the surface for up to 25 million years and contained microbes that were living off hydrogen and methane produced by chemical reactions between the water and rock. Some of the microbes were related to bacteria found near hydrothermal vents; others didn?t resemble any known lineages, Sherwood Lollar says.

The team searched in Ontario because of the rocks? antiquity, but the researchers didn?t expect to find water billions of years old. ?I?m not sure I believed the results to begin with,? says coauthor Christopher Ballentine, a geochemist at the University of Manchester in England.

Before the discoveries in South Africa and Canada, geologists had routinely found traces of ancient water trapped in microscopic bubbles in minerals. But researchers had never found flowing water that old. Sherwood Lollar doesn?t know how much water is trapped deep in the crust at the Canadian site. But at one of the boreholes, water flowed up over several years at rates as high as 400 milliliters per minute.?

The researchers determined the water?s age through several analyses of noble gases dissolved in the fluid. For example, the composition of different xenon forms, or isotopes, matched the expected mix in Earth?s early atmosphere.

The water was probably preserved because this region of Canada has experienced little tectonic activity that would disturb rocks, Ballentine says. Similar pockets of water might exist in any rocks this ancient, which occur worldwide, adds Steven Shirey, a geochemist at the Carnegie Institution for Science in Washington, D.C. ?That?s what?s so exciting,? he says. ?If it could happen here, it could happen any place.?

Short Sale - BOA - Why do they need tax returns? Relocation ... - Loan

Well after years of dealing with BOA we entered into a Short Sale agreement and officially listed our home with the real estate agent in March. We now have a contract on the house and are set to close on July 16th. Our real estate agent just sent me forms from BOA for them to obtain our tax returns for 2012. Why on earth do they need our tax returns? I can't think of any reason they would need them.

We are doing a Cooperative Short Sale and the forms which we signed dated January 17, 2013, state exactly "If the cooperative short sale is successful, you will be entitled to relocation assistance of $5,000-30,000* to assist with moving, rental and relocation expenses." Now on the BOA website, they show relocation expenses for a cooperative short sale is $2,500-30,000. Don't you think they have to pay me the minimum of $5,000 as it states in the agreement we signed in January.

Sony's Xperia ZR is a new, smaller waterproof handset

Xperia ZR

Basically a shrunken down, mid-level Xperia Z

Sony has expanded its Xperia Z family today with the new, 4.55-inch Xperia ZR. Packing many of the same internal components -- and Xperia Z-like waterproof capabilities, (rated IP55 and IP58) the ZR will represent Sony in the mid to high-end space. In fact, Sony's touting its higher IP rating (the Xperia Z is rated IP55 and IP57) as making the ZR ideal for underwater HD video recording, if that's your thing.

Under the hood it's running a 1.5GHz quad-core CPU -- the same Qualcomm Snapdragon S4 Pro that's powering Xperias Z and ZL -- with 2GB of RAM, 8GB of internal storage and a microSD slot. On the front there's a 4.55-inch 720p display (in places described as a 4.6-inch panel, so go figure), and around the back is a 13-megapixel Sony Exmor RS camera with LED flash. All in all, a respectable set of components, and the ZR's curved back should make it a good deal more comfortable to hold than its brick-like sibling.

Sony's press release says the Xperia ZR includes LTE support, but the official spec sheet only mentions HSPA+, so it's possible this may depend on which market you're in. As far as HSPA+ connectivity is concerned, it seems there'll be one version supporting 900 and 2100MHz (for Europe) and another with 850, 1700, 1900 and 2100MHz support, likely for North America.

The Xperia ZR will land in "various global markets" during Q2, so make of that what you will.

This Week On Twitter: Day In The Life Of The Internet, Social ...

Need a little weekend reading? We?ve compiled our top ten Twitter stories of the week, which includes a look at what happens over the course of a day on the internet, 10 social media personality types, a new Twitter-based sensor for diaper changing, a study which reveals how moms are using social media and thoughts on whether social media marketing has lost its way.

Here are our top 10 Twitter stories of the week.

1. A Day In The Life Of The Internet [INFOGRAPHIC]

There are close to two and-a-half billion people online around the world ? this number has grown a heady 566 percent since the year 2000 ? and 70 percent of them use the internet each and every day. As you might imagine, with that kind of presence, which amounts to more than a third of the global population, quite a lot happens over the course of each 24 hours. You want some examples? You got it. Each day, an average of 139,344 new websites go live. An incredible 144 billion emails are sent and received. 500 million people log into Facebook. Hundreds of millions of tweets* are written and exchanged, and, perhaps most amazingly, 60 hours of new video are uploaded to YouTube every single minute.

2. 10 Social Media Personality Types ? Which One Are You? [INFOGRAPHIC]

When you?ve been active on social media platforms such as Twitter and Facebook for a lengthy period of time, you start to develop a personality. This may not be something you?re even aware of. It usually isn?t contrived (although sometimes it blatantly is), but many people, like it or not, become (or slip into the habits of) a certain type of user as they become a veteran of their favourite social media service(s) and, while this will inevitably fluctuate on occasion, they usually revert back to that tried-and-tested social norm once the madness has passed.

3. Huggies Launches TweetPee, A Twitter-Based Sensor For Diaper Changing

Brazilian parents just got a new gadget to add to their parenting arsenal: TweetPee, a sensor + Twitter-based alert Huggies has rolled out in Brazil. A sensor gets attached to the baby?s diaper, and when it perceives an increase in humidity it sends a tweet out to the parent?s Twitter account to let them know the baby needs to be changed.

4. How Are Moms Using Social Media (And Why Does This Matter To Marketers)? [INFOGRAPHIC]

Did you know that a recent study showed that almost half (44 percent) of moms have gone on to make a purchase after a friend posted a recommendation or liked a product on a social media site? We?ve been here before, of course (many times), but it bears repeating ? moms and social media make a great mix, and if these socially savvy ladies are a demographic fit for your business then you should absolutely be engaging with them ? frequently ? within your marketing campaigns.

5. Has Social Media Marketing Lost Its Way? [INFOGRAPHIC]

Remember when it was exciting to receive an email? An email. One. Because, maybe twenty years ago, your email inbox didn?t get an awful lot of action. Heck, you probably didn?t even refer to it as in inbox. It was just ?my email?. Email zero as a concept did not exist, because it was a given. You received an email, and you read it. Done. No more email to read. Until the next time, which might be in another day or two. Of course, email now just part of your job. Something you have to do. And, accordingly and so often, impersonal, automated, and cold. Is this what?s happening to social media marketing, too?

6. Social Sharing Boosts Email Marketing Results By 158% [INFOGRAPHIC]

Email still converts better than social media marketing (or searchfor that matter), but do you know what really works? Combining them together. By adding social sharing icons to your email marketing messages you can increase your click-through rate (CTR) by as much as 158 percent.

7. Social Media And The Growth Of E-Commerce [INFOGRAPHIC]
